DOJ okays transfer of rape case probe versus Subic locator

Olongapo Chief Prosecutor told to conduct initial probe of officials

THE Department of Justice (DOJ), thru the Office of the Prosecutor General, is taking over the preliminary investigation of a rape case filed against a Taiwanese businessman and long-time locator at the Subic Free Port after his counsel complained against the alleged unethical and unprofessional behavior of two officials from the Olongapo City Prosecutor’s Office leading to its alleged “compromised partiality” and potential “miscarriage of justice.”

Prosecutor General Richard Anthony Fadullon, last March 31, also instructed Olongapo City Prosecutor Charlie Yap, to initiate an inquiry against his deputy, Prosecutor Ria Niña Leonor Sususco, as well as others in the OCP.

The complaint against Sususco and Associate Prosecutor Lilia Elizabeth Hinanay-Escuso was filed by the Fernandez Law Office, counsel of the accused, 10 days earlier, last March 21, with an urgent motion for Fadullon to take over the conduct of the preliminary investigation.

In the complaint, Atty. Merito Lovensky Fernandez averred Sususco and Escuso committed “serious irregularities” in handling the complaint, noting that despite being confidential in nature, copies of the complaint ended up in the hands of the press.

He noted that it was only thru press reports that the accused became aware of the accusation against him as he was never formally notified by the Prosecutor’s Office; the accused also only got a copy of the complaint informally when it was given to him by a member of the Law Enforcement Department of the Subic Bay Metropolitan Authority (LED-SBMA).

Fernandez also told Fadullon and Justice Secretary Jesus Crispin Remulla that they questioned the affidavit executed by the alleged victim on February 13 for “manifest irregularities” after Escuso, the attending prosecutor, accepted the affidavit despite the bogus personality of the victim’s alleged mother, ‘Juana Marquez.’

The real mother, Lacsina Ann Sinlao, executed an affidavit on Marh 19, denying she was present when her daughter, ‘MJ’ purportedly executed her affidavit before Escuso.

Sinlao’s lawyer, Atty. Baltazar Beltran, told Secretary Remulla in a separate complaint last March 21, said the incident “involving fake identities of complainants and their custodians is alarming,” as Sususco refused to dismiss the criminal information against the businessman (Pinoy Exposé, April 1, 2025).
